Who can make a data breach claim?


  • To claim compensation you must be able to prove that you suffered as a result of the data protection breach. You can claim for both damages and distress. However, while a person who has suffered damage can have their compensation increased to take into account any associated distress, in most cases compensation will not be awarded for distress alone. The only exception to this is where your information has been used for journalistic, artistic, or literary purposes.
  • You can make a compensation claim against a company without first going to the ICO. However, we would always recommend this as a first step.
