How to claim mis sold Toyota PCP compensation

There is a set process to go through in Toyota PCP claims, with the basic stages as follows:

  • Firstly, you should have your case assessed to check that you are entitled to make a PCP car finance claim for your Toyota contract. You can either fill in our secure online claim form or call us on 0330 041 5137 to arrange a free initial assessment.
  • During the assessment, we will go through the details of your finance agreement with you and also what you were told before you signed. We will let you know whether you are due compensation and the likely amount you could receive.

How to know if you are owed mis sold Toyota PCP compensation

Following numerous complaints from customers, the Financial Conduct Authority carried out an investigation into mis sold PCP finance.

Widespread mis-selling of car finance was uncovered, with failures to explain contracts, intentionally misleading advice and hidden commission payments. In many instances, lenders encouraged dealers to charge their customers higher interest rates in return for receiving a higher level of commission for themselves.

Car finance companies are required by law to fully explain the implication of PCP agreements to you, to include setting out the amount of commission that is being paid. If you have not been properly advised before signing the contract, it is likely to have been mis–sold to you.

Examples of the mis selling of PCP agreements include where the salesperson:

  • Didn’t properly explain all of the details of the finance deal to you, such as:
    • Who owned the vehicle (e.g. if it was a third-party hire purchase company rather than the dealer themselves)
    • Interest rates
    • Charges and fines for breach of the agreement
  • Did not explain they were receiving a commission or how this worked
  • Pressured you or rushed you to make a decision
  • Told you a particular finance package was their recommendation (you should always be presented with a range of options and the salesperson should remain impartial)
  • Failed to carry out appropriate credit, income and affordability checks
