How to know if you are owed mis sold Nissan PCP compensation

Mis sold PCP came to public attention when the Financial Conduct Authority (FCA) opened an investigation following complaints about PCP agreements. The FCA found that mis selling was widespread, with car buyers being given poor advice or being intentionally misled about the implications of their contract.

Those offering car finance are required by law to notify customers of all of the details of a PCP agreement. This includes clearly setting out the amount of commission that the dealer or broker will receive. Where the commission has been hidden in interest payments or not properly disclosed, mis selling has occurred.

You should also have been made aware of how much the vehicle might be worth at the end of the deal and any penalty fees for an early exit from the contract.

Examples of PCP car finance mis selling include where the salesperson or dealer:

  • Didn’t properly explain all of the details of the finance deal to you, such as:
    • Who owned the vehicle (e.g. if it was a third-party hire purchase company rather than the dealer themselves)
    • Interest rates
    • Charges and fines for breach of the agreement
  • Did not explain they were receiving a commission or how this worked
  • Pressured you or rushed you to make a decision
  • Told you a particular finance package was their recommendation (you should always be presented with a range of options and the salesperson should remain impartial)
  • Failed to carry out appropriate credit, income and affordability checks
