How to know if you are owed mis-sold MINI PCP compensation

A car finance lender must be transparent about any car finance deal you are planning to sign or it may be considered mis-selling.

The Financial Conduct Authority (FCP) ran an investigation that brought a huge amount of mis-sold car finance to the public’s attention. It exposed many cases of mis-selling where the broker or dealer gained commission if they recommended a specific agreement but did not disclose this information to the consumer.

In other examples, car finance lenders intentionally provided misleading or incomplete information or other details that they are legally required to tell buyers before they sign the agreement. This goes against the law and is considered mis selling PCP car finance.

Examples of mis-selling car finance can include where a salesperson:

  • Didn’t properly explain all of the details of the finance deal to you, such as:
    • Who owned the vehicle (e.g. if it was a third-party hire purchase company rather than the dealer themselves)
    • Interest rates
    • Charges and fines for breach of the agreement
  • Did not explain they were receiving a commission or how this worked
  • Pressured you or rushed you to make a decision
  • Told you a particular finance package was their recommendation (you should always be presented with a range of options, and the salesperson should remain impartial)
  • Failed to carry out appropriate credit, income and affordability checks
